The legal force of decisions of the Constitutional Court of the Russian Federation in the context of the discussion on the abolition of the moratorium on death penalty

Abstract

The article examines the problematic aspects of the legal force of decisions of the Constitutional Court of the Russian Federation (RF), their place in the legal system of the state and the system of sources of law. The work reveals the issue of the legal force of the legal positions of the Constitutional Court of the Russian Federation in the context of public discussions on the possibilities of abolishing the moratorium on the death penalty and taking into account the opinion prevailing in the legal community about the absence in modern legislation of any legal mechanisms to overcome the definition of the Constitutional Court of the Russian Federation of November 19, 2009 No. 1344-O-R, which enshrined the indefiniteness of the moratorium on death penalty and made its sentencing and implementation on the territory of Russia under the current Constitution of the Russian Federation impossible.
